Relazioni familiari, identità di genere e autonomia personale tra diritti religiosi e ordinamenti civili

After retracing the progressive detachment of religious and civil models of marriage, the essay illustrates the general decline of marriage as an institution and the affirmation of cohabitations practically free from legal constraints. The reason for these changes must be sought in the rootedness of a new anthropology that places itself outside the idea of nature and, on the contrary, brings all desires back to man's power. The breadth of subjective rights today tends to include not only medical-assisted procreation for same-sex couples, but also single parenthood. Now, we must therefore speak, on the one hand, of family relationships without family; and, on the other, of human beings who no longer have a certain biological provenance and their own history. But we cannot forget that, in the development of humanity, identity represented the primary foundation of freedom.

Il saggio, dopo aver ripercorso il progressivo distacco dei modelli religiosi e di quello civile di matrimonio, illustra il tramonto dell’istituto matrimoniale e l’affermarsi di forme di convivenza praticamente libere da vincoli giuridici. La ragione di questi cambiamenti va ricercata nell’affermazione di una nuova antropologia che si colloca fuori dall’idea di natura e riporta al potere dell’uomo ogni suo desiderio. L’ampiezza dei diritti soggettivi tende oggi a comprendere non solo la procreazione assistita a favore di coppie dello stesso genere, ma anche la monogenitorialità. Dobbiamo quindi parlare ora, da un lato, di relazioni familiari ormai senza famiglia; e, dall’altro, di esseri umani che non hanno più una provenienza biologica certa e una propria storia. Ma non possiamo dimenticare che, nello sviluppo dell'umanità, l'identità ha rappresentato il fondamento primario della libertà.
