The paper highlights the incompatibility of the current legal framework of urban confiscation with the principle of proportionality. It is underlined that, notwithstanding the tortuous path followed by the Higher Courts to obviate the most repressive profiles of the urban confiscation, it has not yet been possible to eliminate the punitive factor allowing it to find application beyond the strict necessity imposed by the rel-evance of the fact (retrospective judgement) and the definitiveness of the sanction (prospective judge-ment). The author, commenting on a recent judgment stating the inadmissibility of the question of con-stitutional legitimacy of the discipline of urban confiscation, reflects on what could be the conditions for the future re-proposal of the question, this time enabling the Court to make use of its powers of control of proportionality / reasonableness, so as to allow it to recover the legal reasoning developed by its own case law on the subject. The work concludes by proposing a solution deemed compatible with parlia-mentary prerogatives in criminal matters.

Il lavoro mette in evidenza l’incompatibilità dell’attuale assetto normativo della confisca urbanistica con il principio di proporzionalità. Viene sottolineato che, nonostante il tortuoso sentiero percorso dalle su-preme giurisdizioni di garanzia per ovviare ai profili più marcatamente repressivi della confisca urbani-stica, non si sia ancora riusciti ad eliminare il fattore che rende quest’ultima particolarmente afflittiva, consentendole di trovare applicazione oltre la stretta necessità imposta dall’entità del fatto (giudizio re-trospettivo) e dalla finalità della sanzione (giudizio prospettico). L’autore, commentando una recente sentenza di inammissibilità della questione di legittimità costituzionale della disciplina della confisca ur-banistica, riflette su quali possano essere le condizioni per la futura riproposizione della questione, sta-volta attivando la Corte nei suoi poteri di controllo di proporzionalità/ragionevolezza, in modo da permet-terle di recuperare i costrutti argomentativi elaborati dalla propria giurisprudenza in argomento. Il lavoro si conclude con la prospettazione di una soluzione che si ritiene compatibile con le prerogative parla-mentari in materia penale.
