The protection of the sacramental seal and of the priest-penitent privilege in Italy The essay focuses on the protection of the sacramental seal in Italy, as provided by the unilateral legislation of the State and, as for the Catholic Church, by the concordatarian laws: a safeguard that, until now, could have been considered fully satisfying with regard to the various issues implied. Recently, however, both certain tendencies of the Italian case law and some regulations adopted in Canon law in order to make more effective the prevention and the repression of sexual abuses have raised concern. In the light of such developments and in order to face them, we point out possible paths that could lead to a more adequate protection of the need for secrecy on which the regulation of the sacramental seal and the priest-penitent privilege are founded: a need that is rooted, in the Italian legal system, in fundamental constitutional principles.

Il saggio si sofferma sulla tutela, in Italia, del segreto ministeriale, prevista dalla normativa unilaterale statale e, per la Chiesa cattolica, da quella concordataria: una salvaguardia che poteva sinora considerarsi pienamente soddisfacente le diverse istanze implicate. Di recente, però, destano preoccupazione sia alcuni orientamenti della giurisprudenza italiana sia anche alcune disposizioni che si sono adottate nell’ordinamento canonico per rendere maggiormente efficace la prevenzione e la repressione degli abusi sessuali. Alla luce di tali linee evolutive e per fronteggiarle, si prospettano possibili itinerari per presidiare più adeguatamente le esigenze di riservatezza sottese alla disciplina del sigillo sacramentale e del segreto ministeriale: esigenze radicate, nell’ordinamento italiano, in fondamentali principi costituzionali.
