This essay starts from the questions if the mediator of commerce in the Modern Age could be considered a public official. In my opinion it is appropriate to distinguish among different situations, without connecting the mediator to a uniform model because it wasn’t like this. In France starting from 1572 the mediator was a real public office, by royal designation and practised in the monopoly regime. Concerning the Italian peninsula it is impossible to give a uniform speech: on the one hand there were regions clearly conditioned by France (Dominions of the Savoys, the Reign of Naples), on the other hand there were states (Milan and Bologna) where those professionals carried on to characterize themselves for an extremely privatistic aspect. For a matter of time I decided to limit my essay to these only four cases, emblematic of the two typical situations that were present in Italy, however leaving aside the rights and duties of mediators to focus on their appointment, on their number and on the prohibition to exercise the mediation for which wasn’t authorized. My considerations come to an end with the French Revolution, which, in 1791, abrogated the public offices of mediator and business broker, proclaiming the complete freedom to exercise the profession. A liberalization of mediation that will also reverberate in the different states of the Italian peninsula.

Il saggio muove dall'interrogativo se il mediatore di commercio in età moderna poteva considerarsi un pubblico ufficiale. A mio parere è opportuno distinguere tra realtà differenti, senza ricondurre il sensale ad un modello unitario perché così non era. In Francia fin dal 1572, quello del sensale fu un vero e proprio ufficio pubblico, di nomina regia ed esercitato in regime di monopolio. Quanto alla penisola italiana non è possibile fare un discorso unitario: accanto a realtà evidentemente influenzate dalla Francia (Domini sabaudi, Regno di Napoli), ve ne sono altre (Milano e Bologna) dove tali professionisti continuarono a connotarsi per una dimensione squisitamente privatistica. Per questioni di tempo ho deciso di circoscrivere il mio saggio a queste sole quattro casistiche, emblematiche delle due situazioni tipo riscontrate in Italia, tralasciando peraltro diritti e doveri dei mediatori per concentrarmi sulla loro nomina, sul loro numero e sul divieto di esercizio della senseria per chi non era autorizzato. Le mie riflessioni troveranno conclusione con la Rivoluzione francese che, nel 1791, cancellò gli uffici di sensale e di agente di cambio, proclamando la completa libertà di esercizio della professione. Una liberalizzazione della mediazione che riverberò anche nei diversi stati della penisola italiana.
