The contribution analyses the rules and case law concerning the participation of amici curiae in investment arbitration. The study will address three main issues, next to an introductory presentation of the amicus curiae institution in international adjudication. First, an overview of the provisions enabling the participation of amici curiae in investment proceedings will be provided. ICSID, DR-CAFTA, NAFTA/USMCA and UNCITRAL provisions will be studied distinguishing between those concerning participation of non disputing States, which are parties to the agreement («NDS»), and those relating more in general to the participation of non disputing parties («NDP»). Second, the study will focus on problematic issues stemming from amici curiae participation, namely the interpretative value of NDS briefs and the alleged risk of a resurgence of diplomatic protection, on the one hand; and admissibility, transparency and evidentiary issues stemming from NDP participation, on the other. Third, the contribution will address recent developments and proposals for amendments of the relevant regulations governing amici curiae in investment arbitration. Last, the contribution will provide some concluding remarks highlighting the caution exercised by investment tribunals in admitting and evaluating amici curiae briefs.

Il contributo analizza le norme e la giurisprudenza relative alla partecipazione degli amici curiae all'arbitrato degli investimenti. Oltre a fornire una presentazione introduttiva dell'istituto in esame nel processo internazionale, lo studio si divide in tre parti. In primo luogo, viene fornita una panoramica delle disposizioni che consentono la partecipazione degli amici curiae nell'arbitrato degli investimenti. Si analizzano le rilevanti disposizioni ICSID, DR-CAFTA, NAFTA/USMCA e UNCITRAL, distinguendo tra quelle riguardanti la partecipazione degli Stati non parti della controversia, ma parti dell'accordo (non-disputing states o «NDS»), e quelle relative più in generale alla partecipazione di soggetti non parti della controversia (non-disputing parties o «NDP»). In secondo luogo, lo studio si concentra sulle problematiche derivanti dalla partecipazione di amici curiae nell'arbitrato. Con riguardo agli NDS, si analizza il valore interpretativo della loro partecipazione e il rischio che essa costituisca una forma mascherata di protezione diplomatica; con riguardo agli NDP, si approfondiscono le questioni relative all'ammissibilità, alla trasparenza e alle questioni probatorie derivanti dalla loro partecipazione. In terzo luogo, il contributo affronta i recenti sviluppi e le proposte di modifica dei regolamenti pertinenti che disciplinano la partecipazione di amici curiae nell'arbitrato degli investimenti. Infine, il contributo presenta alcune considerazioni conclusive che evidenziano la cautela esercitata dai tribunali degli investimenti nell'ammettere e valutare le memorie degli amici curiae.
