Il diritto a terminare unilateralmente la procedura di recesso dall’Unione europea: note a margine della sentenza Wightman

In the Wightman judgment, the Court of Justice acknowledges the right of a Member State unilaterally to terminate the procedure for withdrawal from the Union (Art. 50 TEU). Although the judgment confirms EU law autonomy in principle, it arguably contradicts it in practice, by relying almost exclusively on international rules and principles, such as sovereignty. Wightman thus suggests that EU Treaties are nothing but “ordinary” treaties.

Nalla sentenza Wightman la Corte di giustizia ha affermato il diritto di uno Stato recedente a terminare unilateralmente la procedura di recesso dall’Unione (art. 50 TUE). Sebbene la sentenza confermi l’autonomia del diritto dell’Unione in linea teorica, pare in realtà contraddirla, fondandosi quasi esclusivamente su regole e principi internazionalistici, come la sovranità. Wightman sembra così suggerire che i Trattati dell’Unione non siano altro che trattati “ordinari”.
