This study analyses the compatibility between the COVID-19-related measures adopted by the Member States of the Council of Europe, and their obligations under the European Convention on Human Rights. The article comes in seven sections, after an introductory one. First, the article provides an overview of the measures adopted by European countries, with special regard to Italy, with a view to evaluate their compliance with recommendations by the World Health Organization, whose functions and role are briefly sketched. Subsequently, the study considers the relevance of «health» within the ECHR, both as a «transversal right» and as a limitation to other human rights. Then, the analysis addresses the possibility to subsume the COVID-19 pandemic into a situation of emergency under Article 15 ECHR and whether the measures adopted by European countries comply with their ECHR obligations. To conclude, the Author argues that the measures adopted by Member States against the COVID-19 pandemic require the activation of Article 15 ECHR.

Il contributo analizza la compatibilità tra le misure di contrasto alla pandemia di COVID-19 adottate dagli Stati membri del Consiglio d'Europa e i loro obblighi in tema di diritti umani derivanti dalla Convenzione europea per la salvaguardia dei diritti dell'uomo. Oltre ad una sezione introduttiva, l'articolo è suddiviso in sette parti. In primo luogo, l'articolo fornisce una panoramica delle misure adottate dai paesi europei, con particolare riguardo all'Italia, al fine di valutare la loro conformità alle raccomandazioni dell'Organizzazione mondiale della sanità, di cui si descrive il ruolo. Si passa quindi a considerare la rilevanza della "salute" all'interno della CEDU, sia come un "diritto trasversale" che come una limitazione di altri diritti umani. L'analisi affronta quindi la possibilità di sussumere la pandemia di COVID-19 in una situazione di emergenza ai sensi dell'articolo 15 CEDU e si analizza se le misure adottate dai paesi europei rispettano i loro obblighi CEDU. Per concludere, l'autore sostiene che le misure adottate dagli Stati membri contro la pandemia di COVID-19 richiedono l'attivazione dell'articolo 15 CEDU.
