Sacramental seal, priest-penitent privilege and obligations to report: the reasons behind the safeguard of the secrecy between Canon law and State law, namely in Italy. The essay examines two classical themes of both Canon law and Ecclesiastical law, which are, respectively, the sacramental seal and the priest-penitent privilege. After recalling and summarizing canonical and secular legislations - and their encounters - as well as the pertaining Italian jurisprudence, some considerations are developed about the current weakening of defense of secrecy in relations between faithful and clergy which seems to take place in Italy and in many countries in the world. Pushed by increasing repression and prevention of child sexual abuse committed by clerics and religious, obligations to report have been introduced both in Canon law and in State laws, but such rules may lead to a serious compression of safeguard of secrecy of sacred ministers: namely, what is being more and more incisively restricted is clergymen’s right to abstain from testifying at trials. In this context, the risk is to forget that we are faced with an important expression of the faithful’s freedom of religion and of conscience.

Il saggio esamina temi classici sia della scienza canonistica sia della scienza ecclesiasticistica: rispettivamente il sigillo sacramentale e il segreto ministeriale. Dopo aver ripercorso e sintetizzato la normativa canonica e secolare nelle reciproche interferenze nonché la giurisprudenza italiana al riguardo, si sviluppano riflessioni sull’attuale affievolimento della difesa della riservatezza dei rapporti tra fedeli e ministri di culto che pare insediarsi in Italia e in diversi Paesi del mondo. Sulla spinta dell’inasprimento della repressione e della prevenzione degli abusi sessuali su minori perpetrati da chierici e religiosi si sono introdotti, sia nell’ordinamento canonico sia nei diritti statuali, obblighi di denuncia che possono finire per comprimere pesantemente la tutela del segreto dei ministri di culto: in particolare si restringe sempre più incisivamente la facoltà di questi ultimi di non prestare testimonianza nei processi. Si rischia così di dimenticare che siamo invece dinanzi ad un’importante estrinsecazione della libertà religiosa e di coscienza dei cives-fideles.
