The Article deals with the new Italian regime for Healthcare Liability and focuses on the primary role granted to clinical practice guidelines. In particular, it investigates the legislative evolution and the interactions among legal formants of the Italian legal system, taking in to account the developments occurred in other Countries (i.e. the US) where the topics of Evidence Based medicine and Clinical Practices Guidelines have been widely analyzed.
