Al crepuscolo della statualità: Carl Schmitt e lo spettro di Benito Cereno

The Author focuses on the centrality of the reflections on the State within the Schmittian work. In particular, the problematic relationship between Political and State is investigated. Although the non-mutual nature of this connection is acknowledged – the State encompasses the Political, but the Political is not entirely embedded in the State –, the (modern) State plays in Schmitt a pivotal role in the definition of the Political, as the subject who is entitled to set the difference between friend and foe, and – in the end – to run the war (jus belli). Even the recognition of the crisis of the jus publicum europaeum does not entail the prefiguration of a real alternative path: Schmitt is not presented by the Author as the starter of a new era, but as the one who recognizes the “specter” of the Melvillian Benito Cereno, that is to say the end of an era and the fact of being its last herald. For these reasons, Carl Schmitt deserves to be still questioned in our transitional uncertain time.

In questo scritto l’Autrice si concentra sulla centralità delle riflessioni sullo Stato nell’opera schmittiana. In particolare viene indagato il rapporto problematico tra statualità e politico. Sebbene venga riconosciuta la natura non reciproca di questa relazione – lo Stato comprende e governa il politico, ma il politico non si esaurisce nello Stato – lo Stato (moderno) gioca ugualmente, per Schmitt, un ruolo di assoluto rilievo nella definizione del politico, nella misura in cui è il soggetto che può distinguere al suo interno tra amici e nemici, e al quale in ultima istanza è ascrivibile lo jus belli. Persino il riconoscimento della crisi dello jus publicum europaeum non comporta la prefigurazione di un vero percorso alternativo: Schmitt è dall’Autrice indicato non come l’iniziatore di una nuova era, bensì come colui che riconosce anzitempo lo “spettro” del Benito Cereno melvilliano, vale a dire la fine di un’epoca e il fatto di esserne l’ultimo testimone. Per queste ragioni Carl Schmitt merita di essere tuttora interrogato, in un’attualità di incerta transizione.
