La sicurezza dei prodotti cosmetici

This paper contains an analysis concerning the regulatory framework of cosmetic products. The aim of the safety standards is to guarantee the safeness of these products and to secure the right of health that is due to each and every consumer who can incur in injuries caused by the use of flawed cosmetics. In this regard, the role played by these standards and the application of the precautionary principle, which constitutes a priority compared to the obligation that companies have to indemnify the tort caused by flawed products, are paramount.

Il presente contributo reca l’analisi della disciplina armonizzata dei prodotti cosmetici che, come per altri settori produttivi, è diretta a garantire un livello elevato di sicurezza dei prodotti al fine di tutelare il diritto fondamentale alla salute del consumatore che può subire lesioni causate dall’uso di cosmetici difettosi. In questo quadro rivestono un ruolo importante gli standards legislativi di sicurezza ed anche l’applicazione del principio di precauzione che rappresenta un obbiettivo prioritario rispetto a quello, pur importante, di garantire il risarcimento del danno da prodotto difettoso.
