ABSTRACT: The essay focuses on the usage of the term misericordia in the postclassical and justinian legislation. The study shows how, in the imperial legislation and, more so, in the justinian’s legislation of the Code and Novels, the term misericordia acquires a polysemous value, unknown to classical sources, in a framework where human mercy, a feature of jurisprudence during the Principate, is accompanied by divine mercy, which comes to light forcefully in the elaboration of Justinians chancellery at the end of the post-classical period.
