This chapter aims to offer an international law analysis of the right of migrant children to participate in the political life of the host State. Although it may appear prima facie provocative – with regard, at least, to basic human rights violations too often suffered by young irregular migrants during their journey – such analysis is not without interest in a global effort to restructure the legal status of migrant children under international law. This chapter begins by shedding light on the general paradigm of international law for the recognition of the right to participate in political life (section 2). It then assesses whether this paradigm may be overcome in the case of migrant children in light of the most relevant universal (section 3.1) and regional (section 3.2) instruments dealing with children’s rights. The final section contains an assessment of what has been discussed in the preceding sections (section 4).
